Changing your premises manager

When your premises manager leaves, loses their personal licence, dies or becomes unable to work you have to tell the licensing board operating in the area your premises are situated within 7 days of the event taking place.
If you’re sending a letter make sure it’s sent recorded or special delivery and check with the post office that it has been delivered. You can deliver it by hand but make sure you take a copy and have it date stamped by the board's staff that it has been received; or if you send an email make sure you send it return receipt and keep the receipt. 
If you have another personal licence holder on your staff and if you have the person's consent you can immediately advise the board that that person will become your new premises manager by making an application to the licensing board for a minor variation to change the name of the premises manager. You can do this at any time within a period of 6 weeks from the date the original premises manager was unable to hold the position. You should send a letter to the board advising them that this change of premises manager should take place from the date specified in your application.
BII Scotland recommend having a spare personal licence holder on your staff as you only have a matter of 6 weeks to recruit, train and, if required, apply for a personal licence for the replacement after which time you will not be able to trade from the premises until the board makes a decision on the variation application. This can take a very long time.
If you don't have a spare personal licence holder on your staff, make sure you put another staff member through the BIIAB Scottish Certificate for Personal Licence Holders (SCPLH) and then apply to the licensing board where that person lives for a personal licence. You can't run a licensed business if you can't sell alcohol so be proactive and don't put your livelihood at risk.
