Urgent Information For Applicants And Licensees

URGENT INFORMATION FOR POTENTIAL PREMISES MANAGERS

In order to operate premises after 1 September 2009 a premises manager has to be named on the premises licence.  A premises manager can only manage one premises. 

Only personal licence holders can be premises managers.

If you have obtained your BIIAB Scottish Certificate for Personal Licence Holders and are to be a premises manager MAKE YOUR APPLICATION FOR PERSONAL LICENCE NOW
If you are a personal licence holder and are to be a premises manager ADVISE THE LICENSING BOARD WHICH GRANTED  YOUR PREMISES LICENCE NOW

Licensing Boards have to be advised who the premises manager is to be - either by application or letter and subject or otherwise to a fee having to be paid  [check with the licensing  board in which your premises are situated]

If your application for premises licence was made on or before 28 February 2009 there will be a deemed grant of premises licence as from 1 September 2009 until the application for premises licence is granted or refused. 

The Scottish Government  is offering a limited dispensation to applicants to ensure they can continue trading from 1 September 2009 – 1 November  2009 providing they comply with one of  the following:-

1. The premises licence has been granted  on or before the 31 July 2009 and the premises manager specified in the licence does not hold a personal licence

2. The premises licence has been applied for before 28 February 2009 and has not been granted and the premises manager specified in the application does not hold a personal licence

3. A premises licence has been granted on or before 31 July 2009 and the premises manager has not been specified

4. A premises licence has been applied for on or before 28 February 2009 and the premises manager has not been specified

5. The person who is to be the premises manager MUST apply for a personal licence by 31 August 2009

6. The applicant for personal licence must have his licensing qualification and must send evidence that he has the qualification with his application for personal licence.

7. YOU MUST HAVE YOUR QUALIFICATION CERTIFICATE ON OR BEFORE 31 AUGUST 2009 and make your application by that date.

BY 31 AUGUST 2009

Premises licence holders or premises licence applicants MUST PROVIDE the licensing board for the area in which the premises sit  AND  [if different]  the licensing board to which the applicant for personal licence who is to be the premises manager has applied with the following information - the name, date of birth and contact address of the specified premises manager or the individual who is to be the premises manager, as the case may be;  This information  may be emailed ONLY if  the Licensing Board to which the information is to be given so agrees to accept email for this purpose. It may be better to hand it in personally to prevent problems.
